Aargau Halbmarathon

INFORMATION FÜR DIE TEILNEHMENDEN ALLGEMEINE TEILNAHMEANNULLATIONSBEDINGUNGEN (TAB)

1 Geltungsdauer

Diese TAB haben Gültigkeit, falls sie zusammen mit der Buchung abgeschlossen worden sind und enden im Zeitpunkt der Startnummerabholung.

2 Annullationsereignisse

A Die Verein AARGAU Marathon gewährt eine Teilnahmeannullation für die folgenden

Ereignisse:

a) Unvorhersehbare, schwere Krankheit, schwere Verletzung, schwere Schwangerschaftskomplikation oder Tod der teilnehmenden Person oder deren

Lebenspartner/in oder engen Familienangehörigen.

b) Schwangerschaft, wenn das Veranstaltungsdatum über der 24. Schwangerschaftswoche liegt oder wenn die Veranstaltung ein Risiko für das ungeborene Kind darstellt;

c) schwere Beeinträchtigung des Eigentums am Wohnort infolge Feuer-, Elementar-, Diebstahl- oder Wasserschaden, sodass eine Anwesenheit zu Hause unerlässlich ist.

B Im Falle einer chronischen Krankheit erbringt die Verein AARGAU Marathon die Annullationsleistungen falls die Teilnahme wegen unvorhersehbarer, schwerer akuter Verschlimmerung

dieser Krankheit annulliert werden muss oder als Folge der chronischen Krankheit der Tod eintritt.

3 Annullationsleistung

Verein AARGAU Marathon vergütet maximal den Betrag des bezahlten Startgeldes für den entsprechend gebuchten Startplatz begrenzt. Zusätzlich zum Startplatz gebuchte Leistungen

sind nicht vergütungsberechtigt.

4 Geltungsausschlüsse

Diese TAB gelten nicht in den Fällen von:

a) Veranstaltungsabsagung aus objektiven Gründen oder höherer Gewalt (z.B. Epidemien oder Pandemien);

b) Leiden, Komplikationen oder Folgen einer zum Zeitpunkt der Buchung bereits geplanten medizinischen Behandlung oder Operation;

c) Krankheiten oder Folgen eines Unfalls, einer Operation oder eines medizinischen Eingriffs, die zum Zeitpunkt der Buchung bereits bestanden haben und bis zum Beginn der

Veranstaltung nicht abgeheilt sind.

5 Obliegenheiten im Annullationsfall

A. Wenden Sie sich an Verein AARGAU Marathon, Neudorfstrasse 4, 5734 Reinach, info@aargau-halbmarathon.ch

B. Die Teilnehmenden sind bemüht, alles zu unternehmen um eine Annulation abzuwenden.

C. Der Verein AARGAU Marathon sind mindestens die folgenden Dokumente/Informationen unverzüglich einzureichen:

• die Dokumente bzw. offiziellen Atteste, die den Eintritt des Annullationsfalls belegen;

• die Zahlungsverbindung (IBAN und SWIFT-BIC ).

D. Bei Erkrankung oder Unfall nach dem Zeitpunkt der Buchung ist ein Arzt beizuziehen; dieser ist über die beabsichtigte Teilnahme an der Veranstaltung zu orientieren und seinen

Anordnungen ist Folge zu leisten. Die behandelnden Ärzte sind in diesen Fällen von der Schweigepflicht gegenüber der Verein AARGAU Marathon zu entbinden.

E. Die Leistungspflicht der Verein AARGAU Marathon entfällt, falls vorsätzlich unwahre Angabengemacht, Tatsachen verschwiegen oder die verlangten Obliegenheiten unterlassen werden.

6 Ansprüchen gegenüber Dritten

Ist der/die Teilnehmer/in von einem haftpflichtigen Dritten oder dessen Versicherer entschädigt worden, entfällt eine Vergütung aufgrund dieser TAB. Ist die Verein AARGAU

Marathon anstelle des Haftpflichtigen belangt worden, hat der/die Teilnehmer/in ihre Haftpflichtansprüche bis zur Höhe der Annullationsentschädigung der Verein AARGAU Marathon

abzutreten.

7 Weitere Bestimmungen

A. Die Ansprüche verwirken innert 10 Tagen nach der Durchführung der Veranstaltung.

B. Als Gerichtsstand gilt der Sitz der Verein AARGAU Marathon.

Participation Annulation Conditions (PAC) – Aargau Halbmarathon

INFORMATION FOR THE PARTICIPANT PARTICIPATION ANNULATION CONDITIONS (PAC)

1 PERIOD OF VALIDITY

These PAC are valid if they have been concluded together with the booking and end at the time of race number collection.

2 CANCELLATION EVENTS

A Verein AARGAU Marathon grants participation cancellation for the following events:

a) Unforeseeable serious illness, serious injury, serious pregnancy complication or death of the participating person or his/her life partner or close family member.

b) Pregnancy if the event date is over the 24th week of pregnancy or if the event poses a risk to the unborn child;

c) severe impairment of property at the place of residence as a result of fire, natural hazards, theft or water damage, so that attendance at home is essential.

B In the case of a chronic illness, Verein AARGAU Marathon will provide cancellation benefits if participation must be cancelled due to unforeseeable, severe acute aggravation of this illness

or death occurs as a result of the chronic illness.

3 CANCELLATION BENEFITS

Verein AARGAU Marathon will reimburse a maximum of the amount of the paid entry fee for the corresponding booked entry place limited. Services booked in addition to the starting

place are not eligible for reimbursement.

4 EXCLUSIONS OF VALIDITY

These PAC do not apply in the cases of:

a) event cancellation for objective reasons or force majeure (e.g. epidemics or pandemics);

b) Suffering, complications or consequences of medical treatment or surgery already planned at the time of booking;

c) illnesses or consequences of an accident, surgery or medical intervention that already existed at the time of booking and have not healed by the start of the event.

5 OBLIGATIONS IN CASE OF CANCELLATION

A. Contact Verein AARGAU Marathon, Neudorfstrasse 4, 5734 Reinach, info@aargauhalbmarathon.ch

B. The participants are obliged to do everything possible to avert a cancellation.

C. At least the following documents/information must be submitted to Verein AARGAU Marathon without delay:

– the documents or official certificates proving the occurrence of the case of cancellation;

– the payment details (IBAN and SWIFT-BIC).

D. In case of illness or accident after the time of booking, a doctor must be consulted; he/she must be informed about the intended participation in the event and his/her instructions must be followed.

In such cases, the attending physicians are to be released from their duty of confidentiality towards Verein AARGAU Marathon.

E. The obligation of Verein AARGAU Marathon to provide benefits does not apply if intentionally untrue statements are made, facts are concealed or the required obligations are omitted.

6 CLAIMS AGAINST THIRD PARTIES

If the participant has been indemnified by a liable third party or his/her insurer, no compensation will be paid on the basis of these PAC. If Verein AARGAU Marathon has been sued instead of the liable party,

the participant must assign his/her liability claims to Verein AARGAU Marathon up to the amount of the

cancellation compensation.

7 FURTHER PROVISIONS

A. The claims will expire within 10 days after the event has taken place.

B. The place of jurisdiction is the registered office of Verein AARGAU Marathon.
